๐ ๐๐ง๐๐จ๐ฎ๐ซ๐๐ ๐ ๐๐ข๐ฏ๐ข๐ฅ, ๐๐ข๐ฉ๐๐ซ๐ญ๐ข๐ฌ๐๐ง ๐๐ข๐ฌ๐๐ฎ๐ฌ๐ฌ๐ข๐จ๐ง ๐จ๐ง ๐ญ๐ก๐ข๐ฌ ๐ฉ๐จ๐ฌ๐ญ.
For anyone who does not already know, Senator Grassley is the Chair of the Senate Committee on the Judiciary, a committee he has served on in different capacities since at least 2009*. Especially given his presence on this committee, I was pleased to see his recent comments this morning in the Des Moines Register regarding President Trump potentially defying court rulings: โHe wouldnโt get away with that and shouldnโtโ. However, the Senator went on to indicate he does not believe the President would go so far as to ignore court rulings.
Here are some of the recent statements which give me concern that this Executive Branch may not give deference to the Judiciary:
โข J.D. Vance stated, โJudges arenโt allowed to control the executiveโs legitimate power.
โข President Trump said โMaybe we have to look at the judges because I think thatโs a very serious violation.
โข Elon Musk posted that a judge โneeds to be impeached, NOW!โ
โข White House Press Secretary Karoline Leavitt claimed, โeach injunction is an abuse of the rule of law and an attempt to thwart the will of the people.โ
It seems likely that these comments are attempting to lay the groundwork for ignoring the rulings of the courts on the grounds that they are not legitimate rulings. In fact, a judge has already ruled that the Executive Branch has not fully complied with recent rulings. ๐๐ญ ๐ข๐ฌ ๐ง๐จ๐ญ ๐ญ๐ก๐ ๐ซ๐จ๐ฅ๐ ๐จ๐ ๐ญ๐ก๐ ๐๐ฑ๐๐๐ฎ๐ญ๐ข๐ฏ๐ ๐๐ซ๐๐ง๐๐ก ๐ญ๐จ ๐๐๐๐ข๐๐ ๐ฐ๐ก๐๐ญ ๐ญ๐ก๐ ๐ฃ๐ฎ๐๐ข๐๐ข๐๐ซ๐ฒ ๐๐จ๐ง๐ฌ๐ข๐๐๐ซ๐ฌ ๐ญ๐จ ๐๐ ๐ฅ๐๐ ๐ข๐ญ๐ข๐ฆ๐๐ญ๐.
In the event the judicial branch oversteps its authority and provides an illegitimate ruling, it is the role of Congress to step in. Congress has the power to write new legislation which would either clarify or codify the ruling deemed to be judicial overreach โ of course, this would also require a Presidential approval. Congress also has the power to impeach federal judges and remove them from office if they are deemed to have violated their oath to the Constitution. Regardless of which action is most prudent, both lie with the Legislative Branch. ๐๐ญ ๐ข๐ฌ ๐ง๐จ๐ญ ๐ญ๐ก๐ ๐ซ๐จ๐ฅ๐ ๐จ๐ ๐ญ๐ก๐ ๐๐ฑ๐๐๐ฎ๐ญ๐ข๐ฏ๐ ๐๐ซ๐๐ง๐๐ก ๐ญ๐จ ๐๐๐๐ข๐๐ ๐ฐ๐ก๐๐ญ ๐ญ๐ก๐ ๐ฃ๐ฎ๐๐ข๐๐ข๐๐ซ๐ฒ ๐๐จ๐ง๐ฌ๐ข๐๐๐ซ๐ฌ ๐ญ๐จ ๐๐ ๐ฅ๐๐ ๐ข๐ญ๐ข๐ฆ๐๐ญ๐.
The likelihood that our current Executive Branch decides not to honor the rulings of the Judicial Branch seems to be higher than ever before in my lifetime; I would also like to point out I find it possible the Executive Branch does not comply with rulings while claiming they are in compliance. Given this increased likelihood, I have asked my representation in Congress: ๐๐ ๐ญ๐ก๐ ๐๐ซ๐๐ฌ๐ข๐๐๐ง๐ญ ๐๐ก๐จ๐จ๐ฌ๐๐ฌ ๐ญ๐จ ๐๐ข๐ฌ๐ซ๐๐ ๐๐ซ๐ ๐ญ๐ก๐ ๐ซ๐ฎ๐ฅ๐ข๐ง๐ ๐ฌ ๐จ๐ ๐ญ๐ก๐ ๐๐ฎ๐๐ข๐๐ข๐๐ฅ ๐๐ซ๐๐ง๐๐ก, ๐ก๐จ๐ฐ ๐ฐ๐ข๐ฅ๐ฅ ๐ฒ๐จ๐ฎ ๐ฎ๐ฌ๐ ๐ฒ๐จ๐ฎ๐ซ ๐๐จ๐ง๐ฌ๐ญ๐ข๐ญ๐ฎ๐ญ๐ข๐จ๐ง๐๐ฅ ๐๐ฎ๐ญ๐ฒ ๐ญ๐จ ๐๐ก๐๐๐ค ๐ญ๐ก๐ ๐๐ซ๐๐ฌ๐ข๐๐๐ง๐ญ? *I was unable to find a list of Senate Judiciary Committee Members from the 110th Congress and before, though I admit I did not try terribly hard.
